España es uno de los paÃses donde la profesión de detective privado está mas legalizada y "profesionalizada"
Por este motivo, es importante conocer cuáles son los requisitos para ejercer la profesión y los acuerdos existentes en el caso de los Estados Miembros de la Unión Europea.
El Col.legi Oficial de Detectius Privats de Catalunya ofrece en su site toda la información, además de los cursos complementarios a los que se pueden acceder.
Para ejercer como detectives privados se tendrán que reunir los siguientes requisitos:
Tener la nacionalidad de alguno de los Estados miembros de la Unión Europea o de un Estado parte en el Acuerdo sobre el Espacio Económico Europeo, o ser nacional de un tercer Estado que tenga suscrito con España un convenio internacional en el que cada parte reconozca el acceso al ejercicio de estas actividades a los nacionales de la otra.
Ser mayor de edad.
Poseer la capacidad fÃsica y la aptitud psicológica necesarias para el ejercicio de las respectivas funciones.
Estar en posesión de un tÃtulo universitario oficial de grado en el ámbito de la investigación privada que acredite la adquisición de las competencias que se determinen, o bien del tÃtulo del curso de investigación privada , reconocido por el Ministerio del Interior.
Carecer de antecedentes penales por delitos dolosos.
No haber sido sancionado en dos o cuatro años anteriores por infracción grave o muy grave, respectivamente, en materia de seguridad privada.
No haber sido separado del servicio en las Fuerzas y Cuerpos de Seguridad o las Fuerzas Armadas españolas o del paÃs de su nacionalidad o procedencia en los dos años anteriores.
No haber sido condenado por intromisión ilegÃtima en el ámbito de protección del derecho al honor, a la intimidad personal y familiar oa la propia imagen, vulneración del secreto de las comunicaciones o de otros derechos fundamentales en los cinco años anteriores en la solicitud.
Superar, en su caso, las pruebas de comprobación establecidas reglamentariamente por el Ministerio del Interior, que acrediten los conocimientos y capacidad necesarios para el ejercicio de sus funciones.
En el caso de los de Estados miembros de la Unión Europea o de Estados parte en el Acuerdo sobre el Espacio Económico Europeo , cuya habilitación o cualificación profesional haya sido obtenida en alguno de estos Estados para el desempeño de funciones de seguridad privada en el mismo, podrán prestar servicios en España, siempre que, previa comprobación por el Ministerio del Interior, se acredite que cumplen los siguientes requisitos:
Poseer alguna titulación, habilitación o certificación expedida por las autoridades competentes de cualquier Estado miembro o de un Estado parte en el Acuerdo sobre el Espacio Económico Europeo que les autorice para el ejercicio de funciones de seguridad privada en el mismo.
Acreditar los conocimientos, formación y aptitudes equivalentes a los exigidos en España para el ejercicio de las profesiones de seguridad privada, para lo cual deberán estar en posesión de los siguientes documentos:
En los casos en que el Estado de origen regule las distintas profesiones de seguridad privada, el certificado de competencia o tÃtulo de formación que las acredite como tal. Este certificado o tÃtulo deberá reunir los siguientes requisitos:
Haber sido expedido por una autoridad competente de un Estado miembro, designada con arreglo a las disposiciones legales, reglamentarias o administrativas de ese Estado.
Acreditar un nivel de cualificación profesional equivalente, como mÃnimo, al nivel inmediatamente anterior al exigido en España, mediante el tÃtulo previsto en el artÃculo 19.3 del Real Decreto 581/2017 , 9 de junio , para la profesión de detective privado .
Acreditar la preparación del titular para el ejercicio de la profesión correspondiente.
En los casos en que el Estado de origen no regule las distintas profesiones de seguridad privada, el documento expedido por la autoridad competente, acreditativo de haber ejercido la profesión de que se trate en éste o en otro Estado de la Unión Europea , durante al menos dos años a tiempo completo, en el curso de los diez años inmediatamente anteriores al momento de la presentación de la solicitud, siempre que esté en posesión de uno o varios certificados de competencia o de uno o varios tÃtulos de formación .
En cualquier caso, los dos años de experiencia aludidos no podrán exigirse cuando la persona solicitante acredite una cualificación profesional adquirida a través de la superación de una formación regulada de las definidas en el artÃculo 4.5 del Real Decreto 581/2017 , de 9 de junio , y que corresponda a los niveles de calificación señalados anteriormente.
Tener conocimientos de lengua castellana suficientes para el normal desempeño de las funciones de seguridad privada.
Los previstos en las letras a), i), f), g), h) yi) del primer apartado.
Cuando el nacional de un Estado miembro de la Unión Europea o de un Estado parte en el Acuerdo sobre el Espacio Económico Europeo pretenda el reconocimiento de su calificación como detective privado debe someterse obligatoriamente a una prueba de aptitud sobre derecho positivo español y, además, esta prueba comportará las medidas compensatorias necesarias cuando el candidato se encuentre en alguno de los siguientes supuestos:
Cuando la formación acreditada por el tÃtulo, certificado de competencia o documento justificativo de haber ejercido la profesión de que se trate en éste o en otro Estado de la Unión Europea, sea inferior en un año, como mÃnimo, a la exigida en España para el acceso a las distintas profesiones de seguridad privada.
Cuando la formación recibida corresponda a materias sustancialmente distintas de las superadas para obtener el tÃtulo de formación exigido en España.
Cuando la profesión regulada en España comprenda una o varias actividades profesionales reguladas que no existan en la profesión correspondiente en el Estado Miembro de origen, y tal diferencia esté caracterizada por una formación especÃfica exigida en España y relativa a materias sustancialmente distintas de las cubiertas por el certificado de competencia o el tÃtulo de formación que alegue la parte solicitante.
La pérdida de alguno de los requisitos indicados producirá la extinción de la habilitación y la cancelación de oficio de la inscripción en el Registro Nacional, que será acordada por el Ministro del Interior, en resolución motivada dictada con audiencia del interesado.
La inactividad del personal de seguridad por tiempo superior a dos años exigirá su sometimiento a nuevas pruebas para poder ejercer las funciones que le son propias. Las pruebas podrán consistir en las siguientes modalidades:
Ser declarado apto en las pruebas especÃficas que se convoquen por el Ministerio del Interior al efecto.
Acreditar haber realizado un curso de actualización en materia normativa de seguridad privada, con una duración de, al menos, cuarenta horas lectivas, impartido por un centro de formación autorizado, bien en modalidad presencial o a distancia.

Requirements to become a private detective
Spain is one of the countries where the private detective profession is the most legalized and "professionalized".
For this reason, it is important to know what are the requirements to practice the profession and the existing agreements in the case of the Member States of the European Union.
The Col.legi Oficial de Detectius Privats de Catalunya offers on its website all the information, as well as the complementary courses that can be accessed.
In order to practice as private detectives, the following requirements must be met:
Be a national of one of the Member States of the European Union or of a State party to the Agreement on the European Economic Area, or be a national of a third State that has signed an international agreement with Spain in which each party recognizes access to the exercise of these activities to nationals of the other.
To be of legal age.
Possess the physical capacity and psychological aptitude necessary for the exercise of the respective functions.
To be in possession of an official university degree in the field of private investigation that accredits the acquisition of the competences that are determined, or the title of the private investigation course, recognized by the Ministry of the Interior.
Not having a criminal record for intentional crimes.
Not to have been sanctioned in two or four previous years for serious or very serious infringement, respectively, in matters of private security.
Not to have been separated from service in the Spanish Security Forces or Armed Forces or from the country of their nationality or origin in the previous two years.
Not to have been convicted for unlawful interference in the protection of the right to honor, personal and family privacy or self-image, violation of the secrecy of communications or other fundamental rights in the five years prior to the application.
To pass, where appropriate, the verification tests established by regulation by the Ministry of the Interior, which accredit the knowledge and capacity necessary for the exercise of their functions.
In the case of those from Member States of the European Union or States party to the Agreement on the European Economic Area, whose professional qualification or qualification has been obtained in any of these States for the performance of private security functions in the same, they may provide services in Spain, provided that, after verification by the Ministry of the Interior, it is accredited that they meet the following requirements:
Possess any qualification, qualification or certification issued by the competent authorities of any Member State or of a State party to the Agreement on the European Economic Area that authorizes them to perform private security functions therein.
To prove knowledge, training and skills equivalent to those required in Spain for the exercise of private security professions, for which they must be in possession of the following documents:
In those cases in which the State of origin regulates the different private security professions, the certificate of competence or training title that accredits them as such. This certificate or diploma must meet the following requirements:
Have been issued by a competent authority of a Member State, designated in accordance with the laws, regulations or administrative provisions of that State.
Accredit a level of professional qualification equivalent, at least, to the level immediately preceding the level required in Spain, by means of the title provided for in Article 19.3 of Royal Decree 581/2017 , June 9 , for the profession of private detective .
To accredit the preparation of the holder for the exercise of the corresponding profession.
In cases where the State of origin does not regulate the various private security professions, the document issued by the competent authority, certifying having exercised the profession concerned in this or in another State of the European Union , for at least two years on a full-time basis, in the course of the ten years immediately preceding the time of submission of the application, provided that he is in possession of one or more certificates of competence or one or more training qualifications .
In any case, the two years of experience alluded to may not be required when the applicant accredits a professional qualification acquired through the passing of a regulated training of those defined in Article 4.5 of Royal Decree 581/2017 , of June 9 , and corresponding to the qualification levels indicated above.
Have sufficient knowledge of Spanish for the normal performance of private security functions.
Those provided for in letters a), i), f), g), h) and i) of the first paragraph.
When the national of a Member State of the European Union or of a State party to the Agreement on the European Economic Area seeks recognition of his qualification as a private detective, he must compulsorily undergo an aptitude test on Spanish positive law and, in addition, this test will entail the necessary compensatory measures when the candidate is in any of the following cases:
When the training accredited by the diploma, certificate of competence or document proving having exercised the profession in question in this or in another State of the European Union, is at least one year less than that required in Spain for access to the different private security professions.
When the training received corresponds to subjects substantially different from those passed to obtain the training qualification required in Spain.
When the regulated profession in Spain includes one or more regulated professional activities that do not exist in the corresponding profession in the Member State of origin, and such difference is characterized by a specific training required in Spain and relating to substantially different subjects from those covered by the certificate of competence or the training certificate that the applicant claims.
The loss of any of the aforementioned requirements will result in the termination of the authorization and the ex officio cancellation of the registration in the National Register, which will be agreed by the Minister of the Interior, in a reasoned decision issued after hearing the interested party.
The inactivity of security personnel for a period of more than two years will require them to undergo new tests in order to be able to perform their functions. The tests may consist of the following modalities:
Be declared apt in the specific tests called by the Ministry of the Interior for this purpose.
Proof of having completed a refresher course on private security regulations, with a duration of at least forty teaching hours, given by an authorized training center, either in classroom or distance mode.
Advanced Research Courses (CAI)
