Maribel Doria Medina Pozo, Diplomada en Ciencias Forenses e Investigación de la Escena del Crimen, Perito en Criminalista y Licenciada en Ciencias Jurídicas y Políticas nos introduce en el mundo jurídico forense de su país de origen, Bolivia que tiene una idiosincrasia muy particular en lo referente a esta profesión.
"Bolivia, país soberano mediterráneo sin acceso al mar, situado en América del Sur, con una población aproximada de 12.000.000 de habitantes.
El pueblo Boliviano, de composición plural y pluralismo político, económico, jurídico, cultural, social, religioso y lingüístico, está conformado por bolivianas y bolivianos, naciones y/o pueblos indígenas originarios campesinos, comunidades interculturales y afro bolivianos.
Con estos antecedentes, me permito hablar de la aplicabilidad en Bolivia de la Criminología y la Criminalística en el ámbito Jurídico Penal, siendo más específicos aún y abordando la investigación de muerte de personas en rituales de ofrendas y sacrificios.
Hoy en día, en Bolivia las ofrendas y los ritos, son parte de la cosmovisión andina y de las prácticas ancestrales, como parte de una religión, cultura, sociedad, educación, etc., con el objeto de honrar, agradecer o pedir prosperidad a deidades andinas; son rituales ceremoniosos que buscan convivir en perfecta armonía con la madre tierra, promoviendo valores para el vivir bien.
Sin embargo, como en toda actividad humana, vamos a encontrar comportamientos antisociales, que son objeto de estudio y de investigación judicial, criminológica, criminal y forense, siguiendo las bases del método científico, con la finalidad de promover mecanismos para su prevención y tratamiento.
Es así que, dentro estos rituales de ofrendas y ritos, existen personas con conductas desviadas, que aprovechan esta práctica, para cometer delitos contra la vida humana; exponemos a continuación una secuencia de acciones y actividades, que se desarrollan a la noticia de este tipo de delitos:
En su mayoría son personas naturales, quienes informan a la Policía Boliviana del hallazgo de un cadáver que se encuentra enterrado, en las alturas de las cumbres, donde observaremos en estas escenas montículos de piedras colocadas una sobre otra, sin embargo, también se han reportado hallazgos de cadáveres sepultados en el interior de obras civiles, y así mismo en el interior de las minas de donde se extraen minerales.
Una vez que la Policía se encuentra en el lugar de los hechos, inmediatamente va a proteger y acordonar la escena del delito, paulatinamente reportará al Fiscal de Materia, sobre las características de la escena y el tipo de muerte que sugiere la misma, inmediatamente la Autoridad Fiscal convocara al personal especializado en investigación criminal y forense, quienes deberán constituirse de forma inmediata al lugar del hecho.
Una vez que el personal de investigaciones se encuentra en escena, y preparados con todo el material de protección, se va a determinar la técnica de investigación que requiera la escena según su topografía, los expertos inician la búsqueda de indicios y/o evidencias que estén relacionadas con el hecho, cabe mencionar que, vamos identificar los siguientes elementos: “sullus” (fetos de animales destinado a rituales de ofrendas), hojas de coca, restos de mistura y serpentina, cigarros, botellas de alcohol, vino, lanas de colores, dulces y restos de K’oa (mesa andina) incinerados, una vez realizada la fijación de estos elementos, mediante el uso de señaléticas, testigos métricos y fotografía forense, posteriormente se va a colectar, levantar, embalar y rotular estos elementos mediante actas judiciales donde se va proteger nuestra evidencia y cadena de custodia, con el objeto de ser enviados a los laboratorios o unidades de investigación criminal y forense.
Posteriormente personal de investigación criminal e investigación forense, conjuntamente a los expertos en Antropología y Tanatología Forense, procederán a exhumar el cadáver de la fosa clandestina individual y se determinara si el experto en Antropología va a realizar la valoración en cuanto a restos óseos o, por el contrario, será competencia del Tanatólogo Forense en caso de evidenciarse tejidos blandos en el cadáver.

El Equipo Multidisciplinario realizará el apoyo a los Médicos Forenses, en la valoración del cadáver con los Peritos en Criminalística, fotografía, video, planimetría y dibujo forense, conjuntamente con el personal de laboratorio de la Policía, finalizando todo este trabajo técnico científico, con el levantamiento legal de cadáver o restos óseos, para su traslado a la morgue Judicial.
Nuestro principal objetivo como investigadores criminales y forenses, es determinar la identidad de la víctima y entregar el cadáver o los restos óseos a la familia, con relación a la teoría del delito el equipo multidisciplinario bajo la Dirección de la Autoridad Fiscal, llegara a determinar la causa de muerte, el Iter Criminis, la reconstrucción de los hechos y nuestro mayor aporte científico dentro el procesamiento investigativo es identificar e individualizar al Autor del Hecho, tomando en cuenta que en Bolivia no se cuenta con el sistema de identificación AFIS, ni con un banco de datos de perfil genético a través del ADN."

From the legal to the forensic in the Bolivian pluriculturality
Maribel Doria Medina Pozo, Graduate in Forensic Sciences and Crime Scene Investigation, Expert Criminalist and Graduate in Legal and Political Sciences introduces us to the forensic legal world of her country of origin, Bolivia, which has a very particular idiosyncrasy regarding this profession.
“Bolivia is a sovereign landlocked Mediterranean country, located in South America, with a population of approximately 12,000,000 inhabitants.
The Bolivian people, with a plural composition and political, economic, legal, cultural, social, religious and linguistic pluralism, is made up of Bolivian men and women, nations and/or native indigenous peasant peoples, intercultural communities and Afro-Bolivians.
With this background, I would like to talk about the applicability in Bolivia of Criminology and Criminalistics in the Criminal Law field, being even more specific and addressing the investigation of the death of people in ritual offerings and sacrifices.
Nowadays, in Bolivia, offerings and rituals are part of the Andean cosmovision and ancestral practices, as part of a religion, culture, society, education, etc., with the purpose of honoring, thanking or asking for prosperity to Andean deities; they are ceremonious rituals that seek to live in perfect harmony with mother earth, promoting values for good living.
However, as in any human activity, we will find antisocial behaviors, which are the object of study and judicial, criminological, criminal and forensic research, following the bases of the scientific method, in order to promote mechanisms for prevention and treatment.
Thus, within these rituals of offerings and rites, there are people with deviant behaviors, who take advantage of this practice, to commit crimes against human life; we expose below a sequence of actions and activities, which are developed to the news of this type of crime:
In their majority are natural persons, who inform the Bolivian Police of the finding of a corpse that is buried, in the heights of the summits, where we will observe in these scenes mounds of stones placed one on top of the other, however, there have also been reported findings of corpses buried inside civil works, and likewise inside the mines from where minerals are extracted.
Once the police are at the scene of the crime, they will immediately protect and cordon off the crime scene and gradually report to the prosecutor about the characteristics of the scene and the type of death suggested by the scene.
Once the investigation personnel is at the scene, and prepared with all the protection material, they will determine the investigation technique required by the scene according to its topography, the experts begin the search for signs and / or evidence that are related to the event, it is worth mentioning that we will identify the following elements: "sullus" (animal fetuses destined to ritual offerings), coca leaves, remains of mistura and serpentine, cigars, bottles of alcohol, wine, colored wool, candies and remains of incinerated K'oa (Andean table), once the fixation of these elements is done, through the use of signage, Once these elements are fixed by means of signage, metric witnesses and forensic photography, these elements will be collected, lifted, packed and labeled by means of judicial acts where our evidence and chain of custody will be protected, in order to be sent to the laboratories or units of criminal and forensic investigation.
Subsequently, criminal investigation and forensic investigation personnel, together with experts in Anthropology and Forensic Thanatology, will proceed to exhume the body from the individual clandestine grave and will determine whether the expert in Anthropology will perform the assessment in terms of skeletal remains or, on the contrary, it will be the responsibility of the Forensic Thanatologist in case soft tissues are evidenced in the corpse.
The Multidisciplinary Team will support the Forensic Doctors in the evaluation of the corpse with the experts in Criminalistics, photography, video, planimetry and forensic drawing, together with the laboratory personnel of the Police, ending all this technical scientific work, with the legal removal of the corpse or skeletal remains, for its transfer to the Judicial Morgue.
Our main objective as criminal and forensic investigators, is to determine the identity of the victim and deliver the body or skeletal remains to the family, in relation to the theory of the crime the multidisciplinary team under the direction of the Prosecutorial Authority, will determine the cause of death, the Iter Criminis, the reconstruction of the facts and our greatest scientific contribution within the investigative process is to identify and individualize the perpetrator, taking into account that Bolivia does not have the AFIS identification system, nor a DNA genetic profile database.”
